RECOMMENDATION

Staff recommends the City Council (1) award a construction contract to Toro Enterprises, Inc. as the lowest responsive and responsible bidder in the amount of $4,814,204.53 for Phase 1 of the Safer Fox Hills Project and FY2026-27 Pavement Rehabilitation Project; (2) authorize the Public Works Director and City Engineer to approve change orders to the contract in an amount not to exceed $722,130.68 (15%) to cover contingency costs; (3) authorize a task order in an amount not to exceed $130,264 with Willdan Engineering for construction inspection services for Phase 1 of the Safer Fox Hills Project and FY2026-27 Pavement Rehabilitation Project, pursuant to the City’s On-Call Agreement with Willdan Engineering; (4) authorize the Public Works Director and City Engineer to approve amendments to the Willdan Engineering task order in an additional amount not to exceed $32,566 to cover contingency costs (25%); (5) approve a purchase order with ZICLACITIES S.L. not to exceed $250,000 for modular bus platforms to be installed as part of the Phase 1 of the Safer Fox Hills Project; and (6) waive competitive bidding requirements with ZICLACITIES S.L. pursuant to Culver City Municipal Code section 3.07.075.F.3.

BACKGROUND

The Safer Fox Hills Project is a neighborhood-focused initiative that brings over 2.5 miles of new protected bike lanes to Green Valley Circle, Buckingham Parkway, Bristol Parkway, and Hannum Avenue. In addition to expanding bicycle infrastructure, the project adds three new high-visibility crosswalks across Green Valley Circle and introduces a range of additional pedestrian safety and traffic calming improvements throughout the neighborhood. Together, these changes aim to create a safer, more comfortable, and more connected Fox Hills, for everyone walking, biking, or driving.

The City Council approved the conceptual plans for the Safer Fox Hills Project at its May 28, 2024, meeting. The plans were developed after extensive community outreach and engagement conducted earlier in 2024.

The Pavement Rehabilitation Project, also included in this staff report, is the primary vehicle through which the City repaves and rehabilitates streets. Prior to implementing any Safer Fox Hills Project improvements, Green Valley Circle, Buckingham Parkway, and Bristol Parkway will be repaved as part of the Pavement Rehabilitation Project. These streets have been scheduled for repaving due to their low Pavement Condition Index. Phase 1 of the Safer Fox Hills Project and the FY2026-27 Pavement Rehabilitation Project are collectively referred to in this report as the “Project.”

DISCUSSION

Construction Bids

A Notice Inviting Bids for the Project was posted on PlanetBids on August 24, 2026. On October 22, 2026, the City’s Purchasing Division opened the bids.

As part of the bidding process, bidders are required to submit a bid schedule that provides the unit costs for the various line items that detail the work to be completed. The unit cost is multiplied by the bid quantity to provide the total cost of a line item, as shown using the formula below:

Contractor’s unit cost × line-item quantity = Total cost for line item

In some instances, the total cost for a line item does not equate to the bidder’s unit cost multiplied by the line-item quantity. When these discrepancies arise, staff are required to use the unit cost to calculate the total cost for a line item.

Upon initial bid opening, Hardy & Harper, Inc. appeared to be the low bidder. However, upon verification of the bid schedule, several discrepancies were identified in the line-item totals. Staff recalculated the bid schedule using the unit costs provided by the contractor, which resulted in Hardy & Harper becoming the high bidder by a large margin.

City staff verified the bid schedules for the remaining bidders. A summary of the bids received is provided below:

After a review of the submitted bid documents, staff determined Toro Enterprises, Inc. submitted the lowest responsive and responsible base bid. Staff reviewed the bid proposal and found the bid documents to be complete.

Construction Inspection Services

On July 10, 2023, staff presented to the City Council the results of the request for qualifications process conducted for on-call traffic engineering, civil engineering, construction management, inspection services, facility maintenance, geotechnical, and hazardous material testing. In response, the City Council approved five-year (2023-2028) professional services agreements with 26 individual firms, including Willdan Engineering.

An RFP for Construction Inspection Services was sent to all seven consultants on the 2023-2028 on-call Construction Management and Inspection list. Three responses were received on October 30, 2026. Staff reviewed all proposals and determined Willdan Engineering’s proposal to best meet the needs of the City for this project.

In accordance with City Council Resolution 2026-R057 and the on-call process detailed in the July 10, 2023, staff report, all expenditures with a particular on-call consultant in excess of the Purchasing Officer’s Purchasing Authority (currently $100,000) in a fiscal year must be approved by the City Council. The proposed expenditures with Willdan Engineering exceed this threshold and therefore must be approved by the City Council.

Modular Bus Platforms

A modular bus platform is a prefabricated, raised platform installed in the bike lane at a bus stop, next to the curb, that functions as an extension of the sidewalk. Bicyclists ride up a ramp onto the platform, travel across it, and ride back down a ramp on the other side. Transit buses stop adjacent to the platform, and passengers step directly from the bus onto the platform and cross the bike lane at sidewalk level to reach the sidewalk.

Because the bike lane is raised to sidewalk level at the stop, buses do not need to enter the bike lane, allowing the bike lane to remain protected through the stop.

As part of the Project, modular bus platforms are proposed at eight bus stops throughout the Project limits. Staff recommends issuing a purchase order to ZICLACITIES S.L. for the platforms. Typically, the construction contractor would both purchase and install the platforms. Staff recommends the City purchase them directly instead, with the contractor providing installation only. This approach allows the City to take advantage of discounted pricing from ZICLACITIES S.L. of approximately $80,000. Given these savings, staff further recommends the City Council waive competitive bidding requirements pursuant to Culver City Municipal Code section 3.07.075.F.3, as doing so would be in the best interests of the City.

FISCAL ANALYSIS

Inclusive of contingencies, the total Project cost is $5,949,165.21. The Project will be funded through several sources, including the California Highway Safety Improvement Program (HSIP), Los Angeles County Measure R, the Mobility Improvement Fund, Los Angeles County Measure M, the Special Gas Tax Fund, and the Culver City Public Finance Authority.
