RECOMMENDATION
Staff recommends the City Council adopt a resolution (1) certifying conformance with the Congestion Management Program (CMP) and (2) adopting the CMP Local Development Report.
PROCEDURE:
1. The Mayor seeks a motion from the City Council to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and,
2. The Mayor requests a staff report if desired, and the City Council Members may pose questions to staff as desired; and,
3. The Mayor seeks a motion from the City Council to open the public hearing; and,
4. The Mayor seeks a motion from the City Council to close the public hearing after all public testimony has been presented; and,
5. The City Council discusses the item and arrives at its decision.
BACKGROUND
On November 18, 1992, the Los Angeles County Metropolitan Transportation Authority (LACMTA), acting as the Congestion Management Agency for Los Angeles County, adopted the first Congestion Management Program for Los Angeles County. The CMP is a monitoring program that aims to address the impact of local growth on the regional transportation system by linking transportation, land use, and air quality decisions. Each year, cities must report all development activity to LACMTA as well as the implementation of trip reducing strategies. In the past, the degree to which cities have balanced new development with such congestion mitigation strategies has been calculated via a credit/debit system called the Countywide Deficiency Plan.
For the eleventh year, however, the credit/debit requirement has been temporarily suspended while under evaluation, and Culver City must only report the actual amount of development and demolition that has occurred during the reporting period. Furthermore, the City must submit a resolution self-certifying its conformance to all the requirements of the CMP and future updates. As the Congestion Management Agency for Los Angeles County, LACMTA annually determines the County’s or cities’ conformance or non-conformance.
Culver City’s conformance with the CMP and adoption of the Local Development Report ensures that the City continues to receive its portion of state gas tax revenues and preserves its eligibility for other State and Federal transportation revenues. Failure to adopt the resolution jeopardizes the City’s ability to receive these funds. The self-certifying resolution required by the CMP must be submitted to LACMTA no later than September 1, 2015.
DISCUSSION
The CMP requires the County and cities to:
1. Continue implementation of the CMP Transportation Demand Management (TDM) Ordinance; and,
2. Continue implementation of the CMP Land Use Analysis Program; and,
3. Track new development activity; and
4. Conduct biennial traffic counts and calculate levels of service for selected arterial intersections.
The City of Culver City currently is in compliance with the above requirements.
FISCAL ANALYSIS
CMP conformance is required for the City to receive State gas tax (Section 2105) funds and to preserve the City’s eligibility for other State and Federal transportation dollars. Failure to adopt and submit the resolution to the LACMTA by September 1, 2015 jeopardizes the City’s eligibility to receive these funds. For Fiscal Year 2014/2015, the City received $221,377.14 (to date) in State gas tax (Section 2105) funds.
