RECOMMENDATION
Staff recommends the City Council conduct a public meeting pursuant to Section 54954.6 of the Government Code regarding the proposed new assessment related to the establishment of the Culver City Arts District Business Improvement District.
BACKGROUND
On October 26, 2015, the City Council adopted Resolution No. 2015-R082, a Resolution of Intention to initiate the establishment of a proposed Culver City Arts District Business Improvement District (CCAD BID). The Resolution of Intention specifies the name and boundaries of the proposed CCAD BID, describes the improvements/activities to be funded by the proposed assessment, and specifies the proposed method and basis for levying of the proposed assessment (Attachment 1). On November 9, 2015 a first public meeting was conducted to receive public testimony regarding establishment of the proposed CCAD BID. Comments provided during the meeting were in support of the district formation. However, prior to the noticed Public Hearing, it was discovered that a small percentage of businesses did not receive the initial public notice regarding the proposed BID establishment. While the City made a good faith effort to provide notice to all potentially affected businesses and property owners, to allow the newly-noticed business/property owners a full opportunity to provide comments to the City Council, the Public Hearing was opened and continued to February 8, 2016. Additionally, staff has placed this second “public meeting” on the agenda to again ensure ample opportunity for all business/property owners to provide comment on the proposed CCAD BID.
DISCUSSION
Pursuant to Section 54954.6 of the Government Code, the City is required to conduct a public meeting to receive public testimony regarding the proposed CCAD BID. The official notice was mailed on December 21, 2015 to all those affected business and property owners within the proposed CCAD BID boundary that did not initially receive such notice. The notice included a copy of the adopted Resolution of Intention with exhibits. (Attachment 2)
FISCAL ANALYSIS
There is no fiscal impact to the City in conducting a public meeting relative to proposed CCAD BID formation.
