RECOMMENDATION
Staff recommends the City Council award a construction contract to Premier Developing Services, Inc. (Premier), as the lowest responsive and responsible bidder for the construction of the Hayden Tract Spur Parking Lot Project (Project) in an amount not-to-exceed $811,926.25 ($667,596.25 Base Contract Amount plus $124,330 in Contingency Authority and up to $20,000 in Utility Connection Costs).
BACKGROUND
On January 31, 2012, the City executed an Owner Participation Agreement (OPA) with the Hayden Tract Owners’ Association (Owners) to design and construct an at-grade parking lot on the former Los Angeles County Metropolitan Transportation Authority railway spur in the Hayden Tract (the Project). An amendment to the OPA was executed on May 8, 2015.
The City retained KOA Corporation (KOA) to design the Project and to perform all construction management services. On February 8, 2016, the City Council approved the plans and specifications and authorized the issuance of a Notice Inviting Bids for construction of the Project.
DISCUSSION
The Notice Inviting Bids was posted on the City’s web site and published in industry trade journals. On March 8, 2016, the City Clerk publicly opened all submitted bids. Bid proposals were received from the following firms:
Los Angeles Engineering, Inc. $838,838.00
Environmental Construction, Inc. $837,314.00
Excel Paving, Inc. $826,879.00
Access Pacific, Inc. $778,560.00
KTB Construction $770,742.00
Premier Developing Services, Inc. $667,596.25
Staff and KOA evaluated the bids by weighting various bid components against each other in order to identify any anomalies or outliers. This evaluation determined that the unit costs used by Premier are reasonable and realistic. KOA has performed reference checks on Premier and found no reason for concern. Premier’s bid documents were responsive and complete, including the required bond and evidence of a valid state contractor’s license and current workers’ compensation insurance in accordance with the bid documents. Premier is a known, reputable contractor in the industry and has completed other similar projects.
Staff recommends that the City Council authorize the Community Development Director to approve change orders in an amount not-to-exceed $124,330 if necessary due to unforeseen conditions, and up to $20,000 to fund utility connection costs as the City excluded the cost from the bid documents. The exact amount of the utility connection costs have yet to be determined.
FISCAL ANALYSIS
The OPA calls for the City and the Owners to share in equal amounts the funding of the Project to an amount up to $1,675,850, ($837,925 each) with the City funding up to $124,330 in cost overages. The Project budget includes funds for utility connection. Funding for the utility connection costs will be paid out of the Project budget in an amount up to $20,000 with the actual costs shared equally between the City and the Owners. Any amount in excess of these amounts will be the responsibility of the Owners. The City’s funding is included in the City Council Adopted Budget for Fiscal Year 2015/2016 in the form of former Culver City Redevelopment Agency tax-exempt bond proceeds (appropriated in account 48480000.730100.R3411).

RECOMMENDED MOTION(S)
That the City Council:
1. Award a construction contract to Premier Developing Services, Inc., as the lowest responsive and responsible bidder for the construction of the Hayden Tract Spur Parking Lot Project in an amount not-to-exceed $811,926.25 ($667,596.25 Base Contract Amount plus $124,330 in Contingency Authority and up to $20,000 in Utility Connection Costs); and,
2. Authorize the Community Development Director to approve change orders in an amount not-to-exceed $124,330, if necessary; and,
3. Authorize the Community Development Director to approve utility connection costs in an amount not-to-exceed $20,000, if necessary; and,
4. Authorize the City Attorney to review/prepare the necessary documents; and,
5. Authorize the City Manager to execute such documents on behalf of the City.
