RECOMMENDATION:
Staff recommends the Successor Agency to the Culver City Redevelopment Agency Board (Successor Agency Board) adopt a resolution (Attachment No. 1) approving an Amendment to the Revised Long Range Property Management Plan (Amendment to the Revised LRPMP) prepared pursuant to California Health and Safety Code Sections 34191.3 and 34191.5 and approving related actions.
BACKGROUND:
Pursuant to Health and Safety Code Section 34191.5, within six months after receiving a Finding of Completion from the California Department of Finance (DOF), each successor agency of a former redevelopment agency is required to submit for approval to its Oversight Board and to the DOF a Long Range Property Management Plan (LRPMP) addressing the disposition and use of the real properties of the former redevelopment agency. The Successor Agency submitted a LRPMP in July 2013. After discussions with the DOF regarding the disposition of certain assets listed in the LRPMP, a Revised LRPMP (Revised LRPMP) was approved by the DOF by letter dated March 18, 2014. The Revised LRPMP as approved by the DOF stipulated that certain parcels of real property constituting four (4) parking lots classified as “Properties to be Retained for Future Development” will be transferred to the City for future development, upon which compensation agreements with the affected taxing entities may be required. These four (4) parking lots are:
• 10401, 10555, 10601 Virginia Ave. (Virginia Parking Lot).
• 3713-3715 Robertson Blvd. (Robertson Parking Lot No. 1).
• 3727 Robertson Blvd. (Robertson Parking Lot No. 2).
• 12601 Washington Blvd. (Washington Parking Lot).
DISCUSSION:
On September 22, 2015, Senate Bill No. 107 was signed by the Governor (SB 107) which, among other things, amends Health and Safety Code Section 34191.3 to permit the Successor Agency to amend its Revised LRPMP once solely to allow for the retention of real properties that constitute parking facilities and lots dedicated solely to public parking and do not generate revenues in excess of reasonable maintenance costs of such properties, for governmental use pursuant to Health and Safety Code Section 34181. SB 107 further amends Health and Safety Code Section 34181(a) to expand authorization of the Oversight Board to direct the Successor Agency to transfer to the appropriate public jurisdiction, such as the City of Culver City (City), ownership of assets constructed and used for a governmental purpose including parking facilities and lots dedicated solely to public parking that do not generate revenues in excess of reasonable maintenance costs of the properties.
Unlike properties identified in a LRPMP that are to be “Retained for Future Development”, no compensation agreements are required to be negotiated with affected taxing entities for properties that constitute governmental use or purpose pursuant to Health and Safety Code Section 34181.
The subject four (4) parking lots currently owned by the Successor Agency were constructed and are used to serve the public’s parking needs with affordable parking and do not generate any revenues in excess of reasonable maintenance, operations, and necessary repair and replacement improvement costs of such lots. Therefore, such parking lots qualify as assets used for governmental purposes under SB 107 and the amended terms of Health and Safety Code Sections 34191.3 and 34181.
In order for the Successor Agency to implement the provisions of SB 107 and convey the subject parking lots to the City for governmental use, the Successor Agency Board and the Oversight Board of the Successor Agency to the Culver City Redevelopment Agency must first approve the Amendment to the Revised LRPMP (Exhibit “A” to Attachment No. 1) to reclassify the subject properties in the Revised LRPMP as “To be Retained for Governmental Use.” SB 107 permits only one such amendment to the Revised LRPMP, which amendment must be submitted to the DOF no later than July 1, 2016 for the DOF’s review and approval. If the Successor Agency does not amend the Revised Plan by July 1, 2016 or if the Successor Agency, the Oversight Board or the DOF do not approve the proposed Amendment to the Revised LRPMP, then the subject properties will be transferred to the City for future development, upon which compensation agreements with the affected taxing entities would be required, all in accordance with the existing DOF-approved Revised LRPMP.
Should the Successor Agency Board adopt the proposed resolution, a similar proposed resolution will be submitted to the Oversight Board for consideration and recommended adoption during its regular meeting on April 14, 2016 or as soon thereafter as is reasonably practical. If the proposed resolution is adopted by the Oversight Board, then that resolution will be submitted to the DOF for its review and approval.
Upon the DOF’s approval of the Amendment to the Revised LRPMP which would implement the reclassification of the subject parking lots for governmental use, the anticipated title transfers of the parking lots from the Successor Agency to the City must then be approved by the Successor Agency and the Oversight Board and accepted by the City through separate resolutions. The property transfers may then be subject to review by the DOF for consistency with the DOF-approved Amendment to the Revised LRPMP.
FISCAL ANALYSIS:
There is no fiscal impact created by the adoption of the proposed resolution. .
