RECOMMENDATION
Staff recommends the City Council approve a professional services agreement with the Owen Group, Inc. for Americans with Disabilities Act (ADA) Transition Plan Consultant Services, CIP No. PS-006 in an amount not-to-exceed $207,053 ($188,230 Plus $18,823 in Contingency Authority).
BACKGROUND
On December 14, 2015 the City Council authorized release of a Request for Proposals (RFP) for ADA Transition Plan Consultant Services. The purpose of the RFP was to obtain the services of a professional consulting firm (Consultant) familiar with Federal and State ADA requirements and able to perform the evaluations and assessments needed to complete an ADA required Transition Plan.
The ADA is a federal law, enacted to ensure equal access to all areas of public life (i.e. public accommodations, employment, transportation, state and local government services, and telecommunications) by people with disabilities. The ADA is divided into five Titles (or sections) that relate to different areas of public life. Title II of the ADA requires state and local governments to make their programs, services and activities accessible to persons with disabilities. It also establishes physical access requirements for public facilities (buildings and sidewalks, etc.). The ADA requires that all cities with greater than 50 employees establish an ADA Transition Plan.
An ADA Transition Plan includes two primary components:
1) Self-Evaluation: an evaluation of a city’s current services, policies, and practices, that do not or may not meet ADA requirements and, to the extent modification of any such services, policies, and practices is required, the public entity proceeds with making the necessary modifications.
2) Transition Plan: a transition plan sets forth the steps, cost and timeline to complete the necessary modifications indicated in the Self-Evaluation.
The proposed ADA Consultant will assist the City to create its Transition Plan by completing a Self-Evaluation of the City’s public buildings and sites where programs, services and activities are provided to the public, describe the methods to make the programs, services and activities accessible and develop a proposed schedule and budget to implement these methods. In addition, as part of the ADA self-evaluation the consultant will inspect every sidewalk in the City and provide a list of needed sidewalk repairs. This will be in lieu of the City’s normal periodic sidewalk inspection.
DISCUSSION
Proposals were sent to three pre-qualified firms that are known in the industry and advertised on the City website. The City received proposals from seven firms. Their proposed fees to complete the work are as follows:

Following receipt of the proposals, Staff formed a committee to review the responses and conduct interviews. The committee consisted of the City Building Official, Senior Deputy City Attorney, Public Works Senior Engineer and Senior Management Analyst. Staff then checked references and reviewed prior work the respondents had completed of the type requested. Owen Group has completed or is currently working to complete projects of a similar scale in the cities of Irwindale and Commerce along with a variety of County agencies.
Staff recommends the City Council award a contract to Owen Group, Inc. for ADA Transition Plan Consultant Services based on their detailed understanding of the Project, satisfactory completion of similar work for other cities, competitive pricing, reference checks, and proven ability to complete the work as requested.
The work will be completed in approximately six months from the issuance of a Notice to Proceed following the execution of the agreement. The time to complete the work includes data collection, document preparation, staff consultation, public outreach and preparation of the final Transition Plan.
The final ADA Transition Plan will be presented to the City Council for adoption.

That the City Council:
1) Award a Professional Services Contract to Owen Group, Inc. for Americans with Disabilities Act (ADA) Transition Plan Consultant Services, CIP No. PS-006 in an Amount Not-to-Exceed $207,053 ($188,230 Plus $18,823 in Contingency Authority); and,
2) Authorize the City Attorney to review/prepare the necessary documents; and,
3) Authorize the City Manager to execute such documents on behalf of the City.
